Presumptive Conditions — When the VA Assumes Service Connection

For these conditions, the VA waives the nexus requirement — if you served in the right place at the right time and have the diagnosis, you're covered.

What Are Presumptive Conditions?

Normally, to win a VA disability claim you need three things:

Nexus (Medical Link)
A doctor links the two
For presumptive conditions, the VA waives requirement #3. No nexus letter needed. You just need to prove:
  • You served in the right place at the right time
  • You have the qualifying diagnosis

This dramatically simplifies the claims process. A nexus letter can cost $1,500+ and take weeks — presumptive conditions skip that entirely.

Quick Tip

Even if your condition isn't listed as presumptive, you can still file a claim with a nexus letter. Presumptive just means it's easier — not that other conditions are impossible.

Agent Orange / Herbicide Exposure

Covered Service: Vietnam (1962–1975), Thailand (certain Royal Thai Air Force bases), Blue Water Navy, certain test/storage/cleanup sites

Burn Pits / Airborne Hazards (PACT Act)

Covered Service: Post-9/11 service in covered locations — Iraq, Afghanistan, Southwest Asia, and other covered areas

✅ Constrictive bronchiolitis
✅ Constrictive or obliterative bronchiolitis
✅ Diffuse alveolar damage
✅ Lung cancer of any type
✅ Squamous cell carcinoma of the head and neck
✅ Respiratory cancer of any type
✅ Glioblastoma
✅ Head cancer of any type
✅ Kidney cancer
✅ Lymphatic cancer of any type
✅ Lymphomatic sclerosis
✅ Melanoma
✅ Pancreatic cancer
✅ Reproductive cancer of any type
✅ Any cancer for which DOD determines a link to burn pit exposure

Gulf War Illness (Southwest Asia Service)

Covered Service: August 2, 1990 – present, service in the Southwest Asia theater of operations

Chronic Qualifying Disabilities

✅ Chronic fatigue syndrome
✅ Fibromyalgia
✅ Functional gastrointestinal disorders (IBS)
✅ Undiagnosed illnesses with qualifying chronic symptoms
✅ Medically unexplained chronic multisymptom illness (MUCMI)
Key Point: Gulf War illness covers undiagnosed conditions — if you have chronic symptoms that doctors can't fully explain, you may still qualify.

Camp Lejeune Water Contamination

Covered Service: 30+ days at Camp Lejeune between August 1953 – December 1987

Covered Service: Nuclear weapons testing participation, Hiroshima/Nagasaki occupation forces, certain DOE sites and cleanup operations

Former Prisoners of War (POW)

Covered Service: Any veteran who was a prisoner of war during active military service. Some conditions require 30+ days of captivity.

✅ Dysthymic disorder
✅ Cold injury residuals
✅ Heart disease / hypertension (30+ days captivity)
✅ Stroke and complications (30+ days captivity)
✅ Liver cirrhosis
✅ Nutritional deficiency diseases (beriberi, pellagra)
✅ Osteoporosis
✅ Peripheral neuropathy
✅ Peptic ulcer disease

Chronic Diseases (Within 1 Year of Discharge)

Rule: If diagnosed within 1 year of separation from service (some conditions allow 3 or 7 years), the VA presumes service connection.

Filing Tips for Presumptive Conditions

How to Prove You Served in a Covered Location

  • DD-214: Check your separation document for deployment locations and campaign medals
  • Service records: Request your personnel file (SF-180) for TDY orders, deployment records
  • Buddy statements: Fellow service members can attest to your location
  • Military pay records: Hostile fire / imminent danger pay shows you were in a combat zone
  • PACT Act screening: Request a toxic exposure screening at your VA healthcare facility

What Evidence to Submit

  • Current diagnosis: Medical records showing you have the presumptive condition
  • Service records: Proof of service in the covered location/time period
  • Intent to File (ITF): File one today to protect your effective date while you gather evidence
  • No nexus letter needed: Don't waste money on one for presumptive conditions — the VA already concedes the link
